1. Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without providing any reasons.
The withdrawal period is fourteen days from the day:
a.) on which you or a third party named by you, who is not the carrier, took possession of the goods;
b.) on which you or a third party named by you, who is not the carrier, took possession of the last item of goods;
c.) on which you or a third party named by you, who is not the carrier, took possession of the last partial delivery or last piece;
d.) on which you or a third party named by you, who is not the carrier, took possession of the first item of goods.
To exercise your right of withdrawal, you must inform us (TOSAG Engineering AG, Fuchsweidweg 12, CH-4852 Rothrist, info@gauge-express.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).
To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period has expired.
The right of withdrawal is excluded for custom-made products or products not typically stocked.
2. Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including the delivery costs (except for the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), promptly and in any event no later than fourteen days from the day on which we receive the notification of your withdrawal from this contract and the returned goods. We will use the same payment method for the refund as you used in the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return the goods to us immediately and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods if this loss of value is due to handling of the goods not necessary for checking their nature, characteristics, and functioning.
